Minutes: DECISION Following consultation
with the Chair of the Licensing Committee a decision was made to adjourn the
Hearing of the Licensing Sub Committee on 8 June 2021 at the request of the
Premises Licence Holder’s Legal Representative in order for them to consider any
of the documents they had requested that the Responsible Authority decided to
supply. The adjournment was made
under Regulation 12 of the Licensing Act 2003 (Hearings) Regulations 2005 on
the grounds that the adjournment was required for the Premises Licence Holder
to consider and respond to the information provided by the Responsible
Authorities and in turn for the Licensing Sub Committee to consider the
information the parties wished to submit. The meeting would be adjourned
to a date to be specified as soon as arrangements were made. The time permitted for a
hearing to be arranged had been extended under Regulation 13 of the Licensing
Act 2003 (Hearings) Regulations 2005 as it is considered necessary to do so in
the public interest. Previously the hearing within the time limit set
down by Regulations was adjourned as the panel of the Licensing Sub Committee
was inquorate. A further date of 21
April 2021 was rearranged due to the Premises Licence Holder’s request in view
that it fell within Ramadan. It was in the public interest that the
Licensing Sub Committee heard the review, the information supporting the review
and the Premises Licence Holder’s representations and, therefore, the extension
of time was required. Also, the
extension and the adjournment had been agreed so that the Premises Licence
Holder had sufficient time to consider any additional information received. It would be clarified
with the interested parties that it was for the parties themselves to provide
information in support of, or expanding upon, their representations as each
party saw fit, not the Licensing Authority in its role as decision
maker. The Licensing Sub Committee would
consider the relevant representations provided by the Parties at the hearing
and would make its decision based on the information before it. Parties would be advised
that any additional information they wished to submit for the Licensing Sub
Committee’s consideration should be made at least five days before any
rearranged date to enable sufficient time for the information to be considered
by the parties and the Licensing Sub Committee as it was unlikely that any
further adjournments would be agreed. |
