Licensing Act 2003: Application for Premises Licence - Tiger Ivy, 58 Albert Road, Middlesbrough, TS1 1QD

Minutes:

The Chair welcomed all those present to the meeting and outlined the process to be followed. It was confirmed the report had been received by the applicants, who were present at the meeting, and they understood its contents.

 

The Licensing Manager outlined the report for the sub-committee. As part of his presentation the following points were made:

 

·         The intention to open the venue as a bar had been planned for several months and a Planning application had been submitted.  

·         There had been several meetings held with relevant stakeholders prior to the Planning application being submitted.

·         Since applying for a late-night eatery and cocktail bar concerns had been raised by local residents who objected to the application on the grounds of prevention of public nuisance. The objections were detailed in Appendix two and three of the report.

·         The applicant had met with the Council’s Environmental Health Noise team and the applicant had produced a Noise Assessment. The assessment showed that soundproofing had been carried out.

·         The proposal submitted to Members now included a reduction in opening hours which, in this case, was now up to 11.00pm with last orders having to be placed at 10:30pm. If noise was deemed to be a nuisance after 11.00pm then a review of the licence could be instigated.

·         The application had also been amended so the venue was now a late-night restaurant rather than bar. Because of this amendment conditions 3, 4, 5 and 14 would not be required.

 

At this point in the meeting the Chair invited the applicant to present their case. The Applicant stated that while their original intention was to operate a cocktail bar, following resident objections and expert opinion they felt a restaurant would be a better approach.

 

Members were advised that the proposed restaurant would be a table service with all patrons being shown to their seat with no bar service. Four menus would operate throughout the day and while alcohol was available, this was of a premium nature.

 

In terms of noise reduction; as well as soundproofing the venue would have publicity requesting patrons be respectful of residents and to keep noise to a minimum. The Applicant stated they had 14 years’ experience in the industry and would adopt a hands-on approach. The Applicant had contacted the objectors and expressed a desire to work with them to overcome their concerns.

 

Members were also advised by the Council’s Public Protection Manager that, as the application had changed to a restaurant as the intended use, concerns regarding noise after 11.00am were no longer applicable.

 

At this point in the meeting, all parties other than officers of Legal and Democratic Services withdrew from the meeting.

 

After considering the information presented, the Committee invited the Applicant and other parties to rejoin the meeting.

 

ORDERED that the application for a Premises Licence for Tiger Ivy, 58 Albert Road, Middlesbrough, TS1 1QD be granted with conditions 3, 4, 5 and 14 removed as they were no longer applicable.

 

The applicant was also advised that were anything to change in the operation of the venue the licence could be reviewed.
